Welcome to Certicare.org (the “Site”), operated by Rebecca Martel APRN, FNP-BC (doing business as “Certicare”). These Terms and Conditions (“Terms”) govern your use of the Site and the telehealth services provided by Certicare. By accessing or using the Site and the services provided through the Site (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Scope of Services
2.1 Telehealth Services
Certicare provides telehealth services, including the evaluation, diagnosis, and treatment of mild illnesses and stable chronic conditions via synchronous (live video visits) and asynchronous methods (messaging and forms).
2.2 No Medications Sold
We do not sell or dispense medications. Any prescription medications ordered by our licensed healthcare providers are filled by outside pharmacies, and their costs are not included in Certicare's service fees.
2.3 Limited Availability
- We currently only provide telehealth services to New York residents ages 18 and over.
- We can only provide Services in states where we have healthcare providers licensed to practice. If we do not have a licensed provider in your state, we cannot provide Services to you.
2.4 Ineligible Cases
- We cannot treat severe or emergency medical conditions.
- We cannot serve individuals covered by Medicaid or Medicare.
- We cannot provide certain documents or forms, such as disability or workers’ compensation documentation.
2.5 Discretion of Healthcare Providers
Whether your condition is suitable for telehealth through Certicare is determined by our healthcare providers in their sole discretion. If we determine your condition is beyond the scope of our Services, we reserve the right to refuse or terminate Services.
3. Eligibility
3.1 Age Requirement
By using our Site and Services, you represent and warrant that you are at least 18 years old and are requesting services for yourself only.
3.2 New York Residents
The Services are offered only to users who are currently located in New York.
4. Use of the Site
4.1 No User Accounts Required
We do not require patients to create a user account. To use our Services, you will be asked to fill out a form providing demographic, contact, health, and payment information.
4.2 Accuracy of Information
You agree to provide accurate, current, and complete information, including your present location and state of residence, so we can match you with a properly licensed provider.
4.3 Prohibited Activities
You agree not to use the Site or Services for any unlawful purpose or engage in any activity that could harm the Site, Services, or other users. Prohibited activities include, but are not limited to:
- Attempting to gain unauthorized access to any part of the Site.
- Impersonating others or providing false information.
- Engaging in activities that violate any applicable law or regulation.
5. Payments and Refund Policy
5.1 Fees
You agree to pay all fees for telehealth Services as quoted on our Site or via other Certicare communications. These fees do not include the cost of any medications or treatments ordered by our providers.
5.2 Payment Processing
Payments are processed through Stripe or Square, which are third-party payment processors. By using our Services, you agree to comply with any terms and conditions set forth by these payment processors. Certicare does not store your full payment details.
5.3 No Subscription or Recurring Payments
We do not currently offer subscription-based Services or recurring billing.
5.4 Refund Policy
- No Refund After Evaluation: Once your evaluation by a healthcare provider has taken place, no refund is provided.
- Refund Situations: A refund is issued if (i) Certicare is unable to provide Services to you for any reason, including lack of a licensed provider in your state; or (ii) you cancel the Service prior to the evaluation.
6. User Privacy
We take the privacy of your personal and medical information seriously. Please review our Privacy Policy for details on how we collect, use, and disclose your information. The Privacy Policy is incorporated by reference into these Terms.
7. Intellectual Property
7.1 Certicare Content
All content on the Site, including text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of Certicare or its content suppliers and is protected by U.S. and international intellectual property laws.
7.2 Limited License
Certicare grants you a limited, non-exclusive, revocable license to access and make personal, non-commercial use of the Site. You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Site without express written consent from Certicare.
7.3 Prohibition on Unauthorized Use
You must not copy or reuse our intellectual property for any commercial purpose. Any unauthorized use may result in legal action.
8. Third-Party Services and Links
8.1 Typeform
We use Typeform to collect your demographic and health information. Your interactions with Typeform are governed by their separate terms of service and privacy policy. Certicare is not responsible for the content, privacy practices, or reliability of Typeform’s platform.
8.2 No Endorsement
The presence of any third-party services on our Site does not imply endorsement or responsibility for the content, products, or services provided by these third parties.
9. Medical Disclaimers
9.1 Informational/Educational Content
Any medical information provided on the Site is for general educational and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
9.2 Telehealth Limitations
Telehealth has certain inherent limitations, including possible delays or misunderstandings. You should always seek additional medical advice in person if you experience any severe or worsening symptoms.
9.3 Not for Emergencies
If you are experiencing a medical emergency, call 911 or go to the nearest emergency department immediately. Certicare does not provide emergency services.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer of Warranties
- The Services are provided on an “as is” and “as available” basis.
- Certicare makes no warranties or representations of any kind, express or implied, regarding the operation of the Site, the information provided, or the Services offered.
10.2 Limitation of Liability
- To the fullest extent permitted by law, Certicare and its owner, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use of the Site or Services.
- In no event shall Certicare’s total liability to you exceed the amount you paid for the Service at issue.
10.3 No Guarantee
We do not guarantee that the Services will meet your expectations or achieve any particular result.
11. Indemnification
You agree to indemnify, defend, and hold harmless Certicare, its affiliates, directors, officers, employees, and agents from and against all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your use of the Site or Services, or your breach of these Terms.
12. Termination
12.1 Right to Terminate
We reserve the right to terminate or suspend your use of the Site or Services at any time, for any reason, including if we believe you have violated these Terms or any applicable law.
12.2 Effect of Termination
Upon termination, your right to use the Services will immediately cease. You will remain liable for any outstanding payments due before termination.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
13.2 Venue
You agree that any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in New York, and you consent to the jurisdiction of such courts.
14. Changes to These Terms
We may update or modify these Terms at any time in our sole discretion. If we make significant changes, we will notify you by posting a prominent notice on the Site or by other appropriate means. Your continued use of the Site or Services after changes become effective constitutes your acceptance of the revised Terms.
15. Miscellaneous
15.1 Entire Agreement
These Terms, along with our Privacy Policy, HIPPA Consent, and Telehealth Consent, constitute the entire agreement between you and Certicare regarding your use of the Site and Services.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
15.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15.4 Assignment
We may assign or transfer our rights and obligations under these Terms without restriction. You may not assign or transfer any rights under these Terms without our prior written consent.
15.5 Headings
Headings are for reference purposes only and do not limit the scope or extent of any section.
