Introduction
Welcome to Certicare NP, an asynchronous telehealth platform owned and operated by Rebecca Martel Nurse Practitioner PLLC, doing business as “Certicare NP” (“we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, and related materials (collectively, the “Services”). By using our Services, you acknowledge that you have read, understand, and agree to be bound by these Terms. If you do not agree, please do not use the Services.

Nature of Services

  1. Asynchronous Telehealth: Our platform provides asynchronous telehealth consultations and documentation for mild, non-emergency illnesses to patients located in the state of New York at the time they use our Services.
  2. Patient-Provider Relationship: By using our Services, you understand that you are establishing a patient-provider relationship with Rebecca Martel Nurse Practitioner PLLC.
  3. Educational Information: In addition to telehealth services, our site may provide general educational information and resources. This information is not a substitute for professional legal, medical, or financial advice. While we strive to ensure accuracy, users should independently verify any information, especially that related to employment leave laws.

Eligibility & Use Restrictions

  1. Age & Location Requirements: You must be at least 18 years old to use our Services. You must be physically located in the state of New York during the consultation.
  2. Personal Use Only: You may only use the Services for yourself. Requests for others are not permitted.
  3. Scope of Care: Our Services are intended for mild conditions only. If you have severe or emergency symptoms, please seek in-person or emergency care immediately.
  4. Unsupported Situations: We do not provide documentation for:
    • Court appearances
    • Probation check-ins
    • Drug tests
    • Military service
    • Safety-related work restrictions
    • Insurance claims
    • Disability claims
    • Workers’ compensation cases
    • Documentation confirming miscarriage or other pregnancy complications
      If you need documentation for these or similar situations, you must seek in-person or specialized evaluation.

No User Accounts; Data Collection

  1. No Registered Accounts: Our Services do not require you to create a user account. Instead, you will complete an online form for each request.
  2. Information Provided: When completing the form, you must provide your full name, address, date of birth, gender, current health condition, and other requested details. You may optionally provide your employer’s or educational institution’s name.
  3. Payment Information: Payment for services is collected at the time of booking via a third-party payment processor (e.g., Stripe). We do not store your credit card information. Payment is required before any service is rendered.

Service Fees, Payments & Refunds

  1. Fees: All fees for our Services are charged at the time of booking. The fee structure will be clearly communicated before you submit your request.
  2. No Subscriptions: There are no subscription models; all services are one-time transactions.
  3. Refunds: There are no refunds once a service is rendered. If you are dissatisfied with your documentation, you may request modifications at our discretion, but additional fees may apply for substantial changes or new requests.

Limitations of Medical Absence Documentation

  1. Medical Notes: We issue medical absence documentation that includes your name, birth date, a general reason for absence, and the excused dates, along with the provider’s name, credentials, and a digital signature timestamped in UTC. We may include diagnosis or symptom information at our discretion.
  2. Date Limits on Absences:
    • Standard Limit: Each note can include up to three (3) dates of absence.
    • COVID-19 Exception: If you have a confirmed COVID-19 infection (with proof provided), your note may include up to five (5) dates of absence.
  3. 3-in-30 Rule: Each patient may receive supportive documentation for up to three days of absences in any 30-day period.
  4. 10-Day Span Rule: Documentation can be issued for dates no earlier than 5 days before and no later than 5 days after the date of the patient’s evaluation request.
  5. Employer Requirements: We cannot guarantee that any note or documentation will be accepted by your employer or educational institution. By using our Services, you acknowledge that you have verified your employer’s requirements and understand that acceptance is not guaranteed.
  6. Injury Declarations: If you select “injury” as a reason for your absence, you represent and warrant that the injury did not occur on the job or at school. Our documentation cannot be used for worker’s compensation or insurance claims related to the injury.

Modifications to Documentation & Additional Forms

  1. Changes to Notes: We may, at our discretion, agree to requests for minor changes to the issued documentation. We do not change the excused dates on already-issued notes. Additional time off requests require a new submission and fee.
  2. Employer-Provided Forms: If your employer provides additional forms, we may choose, at our discretion, to complete them for an additional fee. We will determine the information to include based on our professional judgment.

Patient Verification & Fraudulent Use

  1. Verification Requests: Third parties (e.g., employers, schools) may verify the authenticity of our documentation by contacting us at:

  2. We will verify the following information: patient’s name, patient’s birth date, service date and time, dates of recommended absence, recommended return date with no restrictions, and the name and credentials of the healthcare provider.
    To obtain verification, the verifier must provide the patient’s full name, birth date (as provided on the documentation), and the date of the service.
  3. Fraudulent Use: If we discover that a patient has altered our documentation, provided fraudulent documentation to their employer, or otherwise misused our Services, we will no longer provide services to that patient.
  4. Refusal of Service: We reserve the right to refuse service to any patient who files a dispute of their payment with their credit card company, demands excessive refunds, or for any other reason at our discretion.

Intellectual Property

  1. Proprietary Content: All articles, educational materials, forms, resources, and other content on our site and through our Services are proprietary to Certicare NP or licensed to us. You may not reproduce, distribute, modify, or create derivative works without express written permission.
  2. Testimonials & Reviews: We may display patient testimonials on our site or marketing materials. These will be anonymized to protect patient privacy.

Disclaimer of Warranties & Limitation of Liability

  1. No Guarantee of Service Availability: We cannot guarantee continuous availability of our Services. We may cease operations at any time without notice.
  2. Not a Substitute for Emergency Care: Our Services are for mild conditions only and do not replace emergency, urgent, or comprehensive in-person healthcare.
  3. Information Accuracy: While we strive to ensure the accuracy of our educational content, we do not guarantee its completeness or suitability. Users should independently verify information, especially regarding employment leave laws, as we are not attorneys.
  4. Limitation of Liability: To the fullest extent permitted by law, Certicare NP shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or related to your use of our Services, including reliance on issued notes. You assume full responsibility for your use of the Services.

Payment Processing & Third-Party Services

  1. Payment Processor: We use a third-party payment processor (e.g., Stripe) to handle financial transactions. We do not control and are not liable for their actions, errors, or omissions.
  2. Form Hosting: We use third-party platforms (e.g., Typeform) to host and collect patient information. We make reasonable efforts to ensure these platforms are secure and HIPAA-compliant.

Governing Law & Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.
  2. Dispute Resolution: In the event of a dispute, you agree to first attempt mediation or arbitration in New York County, New York, before proceeding to litigation. If mediation/arbitration fails, disputes will be resolved in the state or federal courts located in New York County.

Changes to Terms & Conditions

  1. Modifications: We may update these Terms at any time. We will post revised Terms on our website with a new “Last Updated” date.
  2. Acceptance of Changes: Each time you submit a request or form, you acknowledge and agree to the then-current Terms.

Severability & Entire Agreement

  1. Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severable from the remaining provisions without affecting their validity.
  2. Entire Agreement: These Terms, along with our Privacy Policy and any other agreements expressly incorporated, constitute the entire agreement between you and Certicare NP regarding your use of the Services.
